I don't think they are that far yet.
But that DRM is a good case for buying downloaded content instead of "boxes".
I have purchased about 5 games through the internet and have had no problems (even with EA) when reinstalling after a reformat.
Rumours out there suggest that the DRM is really hurting "Spore". To the point that the pirated copies are significant. I guess that means 'lots' because of a DRM backlash.

My new thinking on DRM's are this. I buy the thing once and then if I have any issues, ever, with reinstalling, etc. I will be "pirating" it after that. I have used this same thing with music for years now too. IMHO, and I think courts would think this too, if I purchased it once, I should not have to purchase again, or even go through too much BS to re DL or install in the future.
I also agree with Spec on downloading content. I have had no issues with any of the multiple games I have bought via DL. The only issue is just time to DL and such, but no biggy there.

Speci is correct about the public backlash against SPORE's DRM. There was an organized campaign against SPORE resulting in people giving it one star on Amazon.com. This will either be used to justify stricter DRM or simply EA loosening it's DRM so that people are not as restricted.
There is one other aspect about this method of DRM: it kills the resale market. Of course, digital DLs do the same, but this restriction on physical media is pretty sorry. The reason people buy physical media is two-fold: probable resale and reinstalation without needing to re-DL or to authenticate should the authenticating company go out of business or decide to stop authenticating that game.
What gets me more is this: the DRM measures do not curb piracy at all - if anything, they increase the incidents as people get fed up with the DRM. The only place where DRM effects piracy when you are playing SPORE is if you want to go online and for that EA could easily have created a simpler situation where it had minimal to no copy protection mechanism's in place and required a valid key to authenticate. chc
It would be better to use something similar to prepaid time cards where there is a known unique key used to authenticate online accounts. SP would not be protected by much if at all, but if you want to play online you would have to have that key. They would be smart to also sell that key on it's own - perhaps someone who obtained a copy of the game would pay for access if it cost $25 rather than the full $50. Such cards would need to be released after the first few months to first year of the game's release.
